Energy Performance Certificates (EPC)
An Energy Performance Certificate (EPC) is legally required when a building is constructed, sold, or rented. An accredited domestic energy assessor conducts the assessment, providing an evaluation of the property’s energy performance and insights into improving energy efficiency and reducing carbon dioxide emissions.
Assessment Duration
EPC assessments typically take 25 minutes to 1 hour for domestic properties and a few hours to several days for commercial properties. Key factors affecting duration include property size, age, and accessibility to areas like loft spaces and heating appliances.
EPC Contents
An EPC includes:
Energy Efficiency Rating: Rated from A (most efficient) to G (least efficient).
Recommendations for Improvement: Suggestions for enhancing energy efficiency.
Estimated Energy Costs: A breakdown of potential energy costs to help with budgeting.
After the assessment, data is uploaded to government-authorized software, and the certificate is emailed within 24 hours of payment confirmation.
Enforcement and Penalties
The Minimum Energy Efficiency Standards (MEES) Regulations are enforced by local authorities. Since 1 April 2018, private landlords cannot let properties with an EPC rating of F or G to new tenants unless an exemption applies. This prohibition extends to all relevant properties from 1 April 2020.
If a landlord is suspected of non-compliance, local authorities may issue a compliance notice and impose financial penalties for breaches.
Maximum Penalty Amounts
Penalties apply per property and breach:
Up to £2,000 for renting out a non-compliant property for less than 3 months.
Up to £4,000 for renting out a non-compliant property for 3 months or more.
Up to £1,000 for providing false information on the PRS Exemptions Register.
Up to £2,000 for failing to comply with a compliance notice.
The maximum total fine per property is £5,000.
New EPC Regulations
Recently, a government press statement highlighted a commitment to improving living standards for tenants by reversing previous relaxations of green policies. The Energy Secretary emphasized the need for intervention to provide warmer, more affordable homes free from damp and mold. A consultation is planned by the end of the year to discuss boosting minimum energy efficiency standards for both private and social rented homes by 2030
